Ron, you stated years that this issue has being going on, did Anyone bring this up before and to whom? The company who did the original work, were they liable? We didn’t sue back then, why now?
Is this a county water/ drainage issue?
1. The flooding was brought to ICI’s attention years ago. Initially the drain was at a lower level than the pond it was supposed to drain into (!), so the pond drained into Dennis’s back yard. They plugged the pipe to the pond and installed a new pipe that runs along the back of homes on the east side of Bella Ln to some kind of drain box that is so completely overgrown we couldn’t find it. Dennis says his yard floods worse but drains faster now, taking only 3-4 days instead of weeks. But that’s still a long time not to be able to run your well pump.
2. This was an ICI issue; SMC isn’t equipped to deal with something like this.
3. We can’t redirect it, per se, without the permission of the South Florida Water Managment District. But Dennis got a $20K quote to install French drains and a pump to pump water to the storm drain at the street, from which it would flow into a pond. We propose in our complaint that ICI pay to fix it.
I’m curious to know if and when was this brought to ICI attention before they turned over HOA?

3. Is there a way you redirect the water flow of the flooded area?

As the developer, ICI was responsible to design and construct effectively graded and drained lots.
It is not a county issue, as Phase IV owners are responsible for their storm water management systems.
